NOTICES, TERMS, AND CONDITIONS

We are Qi-Yo International LLC and we look forward to the opportunity to see you on one of our tours, yoga retreats, and yoga teacher trainings. These terms and conditions (the Agreement) describe what you are legally entitled to expect from us when you purchase travel-related services from or through us, in addition to your obligations as a customer. The terms we, us, and our refer to Qi-Yo International LLC. The term you refers to the customer visiting our website, booking a reservation through us, or otherwise using our services.

 

1. Our Agreement With You

Products and Services

Qi-Yo International may act as intermediary for certain products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, classes, etc.). In cases where we are not a co-vendor of such products and services, you will be entering into a separate de facto contract with such suppliers in connection with such products and services.

Deposits, Reservations, and Payment

Any deposits received from you are non-refundable. Payment of a deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of any supplier(s) involved. We will advise you of the date by which full payment is required.

We reserve the right to refuse personal checks or PayPal as a method of payment. By providing your payment information, you are authorizing us to make the payment arrangements with suppliers, as applicable.

Documentation

Our general practice is to send documents to our customers electronically whenever possible.

 

2. Your Agreement With Us

Your Acceptance of These Terms and Conditions

By booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement, including Parts 1-3 thereof, and any additional terms and conditions of any supplier that are applicable to your booking, travel arrangements, or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel-related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account.

Deposits, Refunds, Cancellations

A 50% deposit is required to reserve your place on a trip. If you decide to cancel arrangements before the balance-due date, any deposits paid are non-refundable. A full refund of any moneys paid will be issued only if the trip is canceled on our end.

If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer.

We are not responsible for a supplier’s failure to pay a refund.

Travel Documents and Destinations

It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the country where you find yourself and/or on short notice in the case of loss, theft, damage, etc.

Prior to booking international travel, we recommend that you review your government’s prohibitions, warnings, and advisories as applicable to your destinations and waypoints. By offering travel to any particular destination, we do not represent that travel to such destination is without risk.

You further agree that, in connection with your activities, you will not permit the use of our services or website by anyone that resides or is staying in a country for which such use is prohibited under U.S. regulations.

Passport, Visa, and Immigration Requirements

It is your responsibility to fulfill the passport, visa, and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of your being unable to travel due to not complying with any such requirements.

Insurance

Travel insurance is a vital part of your travel, and a mandatory element of some travel arrangements. We strongly recommend that you take out adequate insurance for the duration of your journey. We may be able to arrange travel insurance to be provided to you, furnish you a quote, and answer any queries you may have regarding the insurance.

 

3. Additional Terms

We are acting as an independent contractor, and no joint venture, partnership or employment relationship exists between you and us or our suppliers as a result of this Agreement or your use of our website.

We reserve the right at any time to modify this Agreement without prior notice to you. Please refer to our website at multiversalyoga.org from time to time to review the most current version of the Agreement. Your continued access or use of our website or services signifies your acceptance of the modifications to the Agreement. You may not assign your rights or obligations under this Agreement to any third party. We may terminate this Agreement at any time for any reason, and such termination shall not affect any right to relief to which we are entitled at law or in equity.

This Agreement shall be governed by the laws of the State of New York without regard to its conflicts of laws principles. If any provision of this Agreement is found to be invalid, illegal or unenforceable, the enforceability of the remaining provisions will not in any way be affected or impaired.



4. Other Information and Provisions

Travel Advice and Vaccinations

You should refer to the travel advice posted by your government’s foreign ministry for all the countries you intend to visit. Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary.

Important Notice Regarding Airline Reservations

If you arrive at an airline ticket or passenger check-in counter with your confirmed ticket and find that the airline shows no reservation for you – do not leave the counter. Check your ticket. If the status box shows "OK" for the flight in question, the airline policies typically require them to accommodate you on that flight, or if that is not possible, they must either find you a substitute flight or pay you denied-boarding compensation. If necessary, ask to speak to a supervisor.

Where applicable, all airlines tickets are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. You may be charged additional sums to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets or any combination thereof. Acceptance of these terms and conditions hereby signifies your consent to any post-purchase price increases and authorizes Qi-Yo International – if it is selling you tickets or helping to transact such a sale – to charge your credit card for such additional amounts.

Your Booking

Please contact your original booking agent to enquire about changes to your travel arrangements. Please note that all reservation changes are subject to availability and the terms and conditions of the product purchased.

Changes to name details are not allowed by many airlines and other suppliers. While we will endeavor make such a change if necessary, please bear in mind that most airlines and suppliers treat a name change as a cancellation, to which standard conditions and charges would apply.

Flights must be taken in the sequence they appear on your ticket or e-ticket confirmation. If you plan not to take a flight as booked, please contact the airline as far in advance as possible to discuss your options. If you do not check in on time for a confirmed reservation, the airline may register you as a no-show, which could result in extra charges and/or your whole flight itinerary being cancelled and/or render your ticket void.

After you have left your country of origin, it is your responsibility to check with the airline that any onward flights you have confirmed are operating as booked. We strongly recommend that you contact your airline at least 72 hours before the scheduled departure of each flight in order to do this. Please note that for some airlines it is mandatory to confirm with them your intention to fly.

Use of Our Services and Website

You agree that you will only use our website or services to make legitimate reservations or purchases and shall not make speculative, false or fraudulent reservations or reservations in anticipation of demand. You will only use our website and services in compliance with applicable law.

Without our prior written permission, you may not (a) access, monitor or copy any content or information on our website using any robot, spider or other automated or manual device or program, (b) deep-link to any portion of our website, or (c) frame or incorporate any portion of our website into any other website.

Our website may contain links to third party websites that we provide only as a convenience to you. You should take precautions to ensure that whatever links you access are free of viruses, worms, trojan horses or other destructive mechanisms The existence of these links does not imply that we endorse such websites or any included content. We are not responsible for such websites or content or any data privacy practices of such websites.

Indemnification

You agree to indemnify us and our affiliates, and any of our suppliers, and any such parties’ officers, directors, employees and agents from and against any claims, causes of action, demands, losses, damages, or other costs, (including reasonable legal and accounting fees) brought by you or third parties as a result of (a) your breach of this Agreement, (b) your violation of any law or rights of any third party, or (c) your use of our website.

Privacy Policy

You consent to our processing and sharing of personal information about you and other members of your party that you have provided to us in accordance with the terms of and for the purposes set forth in our privacy policy. You represent that you have read and agree to the terms of our privacy policy, which can be found at our website.

Warranties, Disclaimers, and Limitation of Liability

FOR THE AVOIDANCE OF DOUBT, REFERENCES HEREIN TO "US" "WE" AND "OUR" SHALL ALSO REFER TO OUR AFFILIATES. THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES PROVIDED BY US OR OUR SUPPLIERS OR PUBLISHED ON OUR WEBSITE MAY INCLUDE INACCURACIES OR ERRORS, INCLUDING PRICING ERRORS. WE DO NOT GUARANTEE THE ACCURACY OF, AND DISCLAIM ALL LIABILITY FOR ANY ERRORS OR OTHER INACCURACIES RELATING TO SUCH INFORMATION THAT APPEARS ON OUR WEBSITE. IF, DESPITE THE LIMITATION ABOVE, WE ARE FOUND LIABLE FOR ANY LOSS OR DAMAGE WHICH ARISES OUT OF OR IN ANY WAY CONNECTED WITH ANY OF THE OCCURRENCES DESCRIBED ABOVE, THEN OUR LIABILITY WILL IN NO EVENT EXCEED, IN THE AGGREGATE, THE GREATER OF (A) THE SERVICE FEES YOU PAID TO US IN CONNECTION WITH SUCH TRANSACTION(S) ON THIS WEBSITE, OR (B) ONE-HUNDRED DOLLARS (US$100.00) OR THE EQUIVALENT IN LOCAL CURRENCY.

THE LIMITATION OF LIABILITY REFLECTS THE ALLOCATION OF RISK BETWEEN THE PARTIES. THE LIMITATIONS SPECIFIED IN THIS SECTION WILL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THESE TERMS IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

Your privacy is important to us and we endeavor to maintain the privacy of registered users. Please take time to read through this Privacy Policy, including the section on third party advertising to ensure you are aware of how we will use your Personal Information.

• This Privacy Policy will apply to your use of our website www.statravel.com and mobile app which are operated by Qi-Yo Multiversal LLC. (“Qi-Yo Multiversal”). It will also apply when we provide services to you in person in our New York Store, by phone, on or otherwise engage with us.

• When you use our website or request services from us we may collect Personal Information from you. This Privacy Policy explains what Personal Information we collect and how we will only process this information (i) to provide our services to you (ii) to comply with our legal obligations and (iii) for the purposes of our legitimate business interests (namely to analyze the use of our website and services to continually improve our business and your customer experience).

• By continuing to use our website or otherwise requesting services from us, you agree that we can collect, use and transfer your Personal Information as set out in this Privacy Policy.

• We will keep your Personal Information for as long as is required to provide our services to you and to comply with our legal obligations. After this period of time we will delete or anonymize your Personal Information.

• You can ask us to stop using your Personal Information at any time and have the right to ask us to delete any Personal Information that we hold about you. Please send an email to info@multiversalyoga.org. You can also address any questions about this Privacy Policy to this email.

• While we will implement appropriate security measures to protect the Personal Information that we hold, you accept the inherent security implications of disclosing Personal Information online and will not hold us responsible for any breach of security unless such breach has been caused by our negligence.

• Any changes we may make to our Privacy Policy in the future will be posted on our website and, where appropriate, notified to you when you next access the website. It is your responsibility to ensure you are happy with any revised terms.

We will only use information from which you can be identified, such as your name, contact details and ID data ("Personal Information") which is provided to us, or otherwise obtained by us, as set out in this Policy. By visiting and/or contacting us in our store, on the phone or through the website (or otherwise engaging with us), you acknowledge that we may collect, use and transfer your Personal Information as set out in this Policy. Qi-Yo Multiversal reserves the right to change this Policy from time to time and you should therefore check this page frequently to ensure that you are happy with any changes.

 

In this Policy, "Qi-Yo Multiversal", "we", "us" and "our", refer to Qi-Yo Multiversal LLC. This policy applies to our website.

 

When you engage with us (e.g. sending us an email, using live chat, commenting on blogs, contacting us via telephone or visiting or making an enquiry through the website or in a store), you may provide Personal Information about yourself including your name, date of birth and contact details (e.g. your address, email address and telephone number) and your job title and resume where you apply for a role with us. If you consider booking our travel products with us, or requesting any other form of service from us, you may also provide us with your financial information and various other necessary Personal Information (e.g. payment details, passport numbers, visa information).

3. Technical Personal Information that we collect from you

Where you make use of our website we may also collect technical information about your use of the website and certain limited information about your device, your visits to our website and when you contact our staff through the online chat help system which may be considered Personal Information. Technical Information may include:

(a)           Device data. We may collect information about the type of device or platform you use (such as a computer or mobile device) to access our website and your choice of web browser.

(b)           Location data. Your use of our website may generate geographical data, such as the location or time zone of a device or IP address, which we may collect.

(c)            Log data about your visit. Your use of our website automatically generates information about your unique visit which we may collect. This can include uniform resource locators (URLs), data about your internet service provider, the number and timing of clicks to and from the content on our website; which events you view; page response times, download errors, length of visits to certain pages, page interaction data (such as scrolling, clicks, and mouse-overs), email engagement rates and activities, and methods used to browse away from the page. Typically we will not be able to identify you from this information.

(d)           Data about your interactions. Our website may provide you with the opportunity to interact with content in certain ways, such as by sharing content on social media. These interactions create data which we may collect, for example, the contents of a post or comment, or whether a link or image was shared using a particular social media network.

We collect some of the above information via our Qi-Yo Multiversal Live Chat.

Some of the technical data set out above will be collected by cookies that we use on our website.

 

4. Personal Information that we receive from other sources

We may receive information from third parties who collect Personal Information from you and pass it on to us. For example, where someone is booking a flight on your behalf. Where this is the case, the third party is responsible for obtaining the relevant consents from you to ensure you are happy with the ways in which your Personal Information will be used.

5. How we use your Personal Information

We will only use your Personal Information in order to (a) supply the products and/or services you have requested and correspond with you in relation to their provision, (b) provide support to you in respect of these services, (c) improve our website and services, (d) comply with our own legal obligations, (e) perform internal business processes and (f) where relevant, process your application for employment.

 

Marketing Communications and Newsletters

Where you have explicitly consented at the time we collected your Personal Information or where we otherwise have a right to do so, we may also use your Personal Information to send you our newsletters, special offers and other marketing communications, by text message, telephone and e-mail.

If it becomes apparent to us that a minor has requested marketing from us, we will stop marketing to that minor unless we have express consent from an appropriate adult.

 

Opting-in to marketing communications

When you opt-in to marketing communications we will ask you for the following personal details: email address, web tracking consent and your contact preferences. You will also be offered the opportunity to customize your email marketing communications (not compulsory). This information is then used to, where you have opted-in to such communications, (i) email you newsletters and special offers and (ii) text you marketing messages (messages sent by Qi-Yo Multiversal will be free unless a roaming charge is made by your network operator). By opting-in to marketing communications you are agreeing to the personalized tracking of your interactions with our email marketing communications. Information collected includes but is not limited to: which emails you open and which links within the emails you click. The primary purpose of this tracking is for reporting on the performance of Qi-Yo Multiversal’s email marketing communications. On occasion, and in the absence of a completed preference center, we may use this data to personalize your email marketing communications. You have the ability to unsubscribe from the mailing list at any point through the unsubscribe link found in all email newsletters.

 

Booking with us

If you have booked with, or otherwise purchased products or services from us, we may send you marketing communications about similar products and services from time to time. You have the opportunity to opt-out of receiving these marketing communications. We will automatically email you an invitation to receive marketing communications from us and at this time you can choose to receive them, or disregard the email which will mean that you will not be opted-in to receive email communications.

 

Competitions

Qi-Yo Multiversal may run competitions where subscribing to email marketing is a condition of entry. You can unsubscribe to these communications using the link in the email at any time.

 

Job openings

If you have consented to such communications, we may also send you information about our job openings that may be of interest to you and/or inform you about important changes or developments to our services.

6. Sensitive Personal Information

If you wish, you may provide us with some special categories of Personal Information in order for us to provide you with a better standard of service. For example, when booking travel products with us you may provide us with information about your dietary or medical requirements, which may reveal details about your mental or physical health or condition. The provision of this information is entirely voluntary. If you do not consent to our processing of this type of Personal Information, we may be unable to provide you with certain goods and/or services that you wish to book.

7. Your rights

You are entitled to know what Personal Information we hold about you and how that information is processed. If you would like a copy of the Personal Information we hold about you, please contact us via this form.

If you change your mind and decide you do not wish to receive communications from Qi-Yo Multiversal (including our marketing and Checkout Assistance communications), you can unsubscribe by clicking on the 'unsubscribe' link at the bottom of any emails you receive from us. If you have previously agreed to Qi-Yo Multiversal sharing your Personal Information with third parties for direct marketing purposes, you may change your mind at any time by using the unsubscribe option in the relevant communication or contacting the third party directly.

You are entitled to know what Personal Information we hold about you and how that information is processed. If you would like a copy of the Personal Information we hold about you, please contact us via our website or at info@multiversalyoga.org.

You have the right to request that we correct any Personal Information that we are holding about you that is incorrect or incomplete.

You also have the right to ask us to erase or stop processing any Personal Information we have about you where there is no longer a legal ground for us to hold it and, in some circumstances, you have the right to request that we transfer any information we hold about you to a third party. 

If you wish to exercise any of these rights, please contact us as soon as possible. We will promptly correct any information found to be incorrect.

You may also have similar rights with our third-party partners, and you should consult their privacy policies and/or contact them for further information (e.g. airlines with whom you have booked a flight).

8. Third Parties

We may share your Personal Information with third parties where it is necessary (i) for the performance of the services you have requested or booked, (ii) for us to comply with our legal obligations or (iii) for our legitimate business interests.

Some of the services on our website and mobile apps, are delivered or served by third party companies, which may collect information about your use of the services. For example, where you have booked flights with us for a third-party airline, we will need to share your Personal Information with the relevant airline and where this is the case, they shall be the data controller over such information. These third parties may also place or recognise cookies, web beacons or other technology to track your behavior and we advise you to read their privacy policy as to how they will process your data.

We run promotions with third parties at specific times of the year. There will be options to opt-out of sharing data with these third parties via the form for that specific promotion - this will be made very clear.

We use third-party advertising companies to serve ads when you visit our website. Qi-Yo Multiversal is partnered with Google regarding ad serving but also works with several other advertising partners. These companies may use your Personal Information (not including your name, address, email address or telephone number) about your visits, to enhance user experience, offer a greater variety of content and provide advertisements about goods and services of interest to you.

In exceptional circumstance, if we are sold or merged with another company we may disclose your information to a potential buyer, including your Personal Information and other information concerning your relationship with us, so that they can continue to provide the services you have requested.

Data Protection Notice: Your personal data will be processed in accordance with the applicable carrier’s privacy policy and, if your booking is made via a reservation system provider (“GDS”), with its privacy policy. These are available at https://www.iatatravelcenter.com/privacy or from the carrier or GDS directly. You should read this documentation, which applies to your booking and specifies, for example, how your personal data is collected, stored, used, disclosed and transferred. (applicable for interline carriage).

9. Links

Links from our site to external websites do not mean we endorse these websites. We advise you to read the privacy policy applicable to each third-party site you visit, and we will not accept any responsibility for or liability in respect of either the contents or your use of these third party sites.

10. Security

At Qi-Yo Multiversal, payment security is of paramount importance. To give you confidence, our online booking service uses industry-standard encryption technology to ensure that your credit or debit card transaction is secure.

Please note, however, that the transmission of information via the internet is not completely secure and, although we will take steps to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted via the website – any transmission is therefore at your own risk.

11. Changes to this Privacy Policy

Any changes we may make to our Privacy Policy in the future will be posted on our website and, where appropriate, notified to you when you next access our website, book a travel product with us or otherwise request services from us. It is your responsibility to ensure that you are aware of the latest version of this Privacy Policy and by continuing to use our website, request services from us or otherwise engage with us, you will be deemed to have accepted any revised terms.
